Hi Everyone...

I've been working for my new company for almost 2 months now. Their sick leave policy is LEAVE WITHOUT pay for the first 3 months... I've noticed that I do accrue annual leave on my payslip...

I recently had to take a day of work, so I figured I will take annual leave for that day, so that I get paid because I dont have sick leave...

I was told today by HR that any days of during my first 3 months is seen as leave without pay... This means that even though I do accrue annual leave, I still can't use them during the first 3 months...

Is this how it works in Australia, or am I just working for a silly company?

It's unusual, most companies go with the award which allows you to accrue your sick leave as you go and then use it in the first 12 months, same with annual leave. Assuming you are full time, you should have accrued at least 1 day of sick leave after 2 months.

You would need to check which award or agreement you are under first to see whether this is legal.
