Hi,

Can anyone please assist with the following issues. I am 90% comfortable but need some insight..........

Staff member got salary protection insurance, started working for the company and 3 mnths later was diagnosed with cancer. Last 3 years she only worked about 6 months. I started yesterday with the company and was informed that she is returning to work. In the meantime they appointed someone else in her role which gives me that extra challenge in the conversation with her :-)

What I would like to know is:

a) Can you terminate a staff members employment on the basis of permanent illness if they are on a income protection scheme? (just for future reference and not for now)
b) Does a staff member accumulate any leave or other benefits when they are on longterm sickleave
i) when it is unpaid?
ii) When they are on an income protection scheme?

Hope someone can help me? I am based in Perth.

a. I very much doubt you could terminate someone on the basis of insurance they had

b. This I do not know (leave this one for other experts here :)) - but again I would imagine it should make no difference what personal insurance a worker has taken out.
