Paid Personal Leave (Sick Leave)
in the Fair Work Act 2009,
Entitlement to paid personal/carer’s leave
Amount of leave
(1) For each year of service with his or her employer, an employee is entitled to 10 days of paid personal/carer’s leave.
Accrual of leave
(2) An employee’s entitlement to paid personal/carer’s leave accrues progressively during a year of service according to the employee’s ordinary hours of work, and accumulates from year to year.
my questions are:
1. these 'days' are working days and not calendar days, right?
2. when i use the leave calculator, i received 196hours which is about 5 days, why? the start date was 1 Mar 2010; end date is 30 Sept 2012. even if i do start date 1 Mar 2010 and end date is 31 Dec 2012, i get : Under the National Employment Standards, the outstanding personal leave accumulated between 01 March 2010 and 31 December 2012 is 215 hour(s) and 33 minute(s).
i am confused. why does the information says 10 days but the leave calculator provides only 215hrs?
3. am i right to say: paid sick leave = paid personal leave = paid carer's leave = 10 days per year and this 10 days can be carried forward year on year but cannot be encashed?
4. am i right to say: compassionate leave is 2 working days for each occasion subjec to the definition of immediate family as stated in the fair work act 2009?

They are weekdays, Mon-Fri, not including public holidays.

Because 196 hours is not 5 days, it's more like 25 days.
1 March 2010 to 30 Sept 2012 is 2.5 years. So the result is correct.

Without looking at the Act, I would say yes.

Regarding the Bereavement/compassionate leave this is 2 paid days on any permissible occasion (when a person has died or has a life threatening illness for an immediate family member) . It is also not deducted from the accrued personal leave but a separate entitlement. This leave does not accrue each year.
