If there is no written requirement to consult a union of upcoming possible retrenchment in modern award/EA or contract - is there an obligation to notify/consult with union if there is likely to be less than 15 employees affected?

1. If there is no requirement to consult with union then there's no requirement to consult with a union.
2. A small business is one that employs fewer than 15 employees. Some small businesses don't have to pay redundancy pay when making an employee redundant.
