Where would I go to find information about our obligations to someone who has a non-work related injury that potentially makes them unable to complete the inherent requirements of their pre-injury role?
In particular I am interested in termination options (i.e. whether we have any!)
Unfortunately, it seems that the answer to a lot of questions like this is, your lawyer!
Presumably the issue needs to be treated as if they were sick. What happens if a person has an illness which makes them unable to undertake the requirements of a pre-sickness role?
They get a doctor's certificate. Take all their sick leave, possibly take all their annual leave and then go on leave without pay until they can work again.
