    Default redundancy and bullying in workplace

    Hi

    I've been made redundant(all positions offshored in my dept except 1 or 2) and just prior to that I had to go on sick/stress leave because of bullying in the workplace.
    what happens in this case. Do I pursure the bullying as workers comp and what payout would I have to expect here, and would that jeopardise my future engagements with potential employers? What other options do I have.

    Payout for what? Redundancy?

    Hi Moz

    I've been payout for redundancy as the usual and alls well there. I was meaning more on the lines of compensation because of bullying.

    Hi muttonhead,

    I'm no expert in this, but I think you would probably have to go to court and prove that the bullying had caused you long term damage (pain and suffering) and loss of earnings, to get a payout (compensation).

    Was the bullying reported as such?
    If it was, what happened ? - What action did your employer take?
    How long did it go on for?

    Not sure what action the employer took but 2 weeks after I went sick the redundancy mail was sent out to everyone (didnt see the sabtuers name in the list).
    bullying was going on for a year by managers and 2 team members. breaking point was when i found out 1 team member sabotaged my working environment and I had proof of it. Also the team member who sabotaged was the only person managing the env. Also the manager who was incharge of the person sabotaging the env was also the major person bullying by giving me work outside of what I should be doing and then put me in situations to try and knock back my performance review. In short they wanted me out of the company by the look of it.

    I think you really need to speak to a lawyer. An employment law specialist will quickly be able to determine whether it is worth pursuing. Alternatively you could call Fair Work first and see what they say.
