    Default Unable to fulfill role

    Hi,

    Just a quick question/situation. Let say we hired an employee. Role requires the employee to use own car to travel to clients. For whatever reason the employee lost license, doesn't have car anymore etc.
    Really, this employee is of no use to us now, as they are unable to fulfill the role. Is this enough of a reason to terminate employment? Would this hold re: unfair dismal?

    As a footnote, although our JDs reference the requirement of "own transport and license". Our employment contracts don't really make reference to the JDs or transport. They just have generic language about performing duties to best of abilities etc.

    Depends on the importance of the licence to the role and whether alternatives can come into play. Do they need to visit clients for sales / relationship matters and could use public transport for example.

    We have blue collar workers required to drive trucks to various sites and work solo from them. Anyone loses their licence we try to find alternative employment for them, however if unable to we have to let them go and do not have issues from numerous cases so far in this regard

    Yes, they need to visit clients for sales / relationship matters. And certainly public transport is an option and weare presently using that option. But a 1/2 hour trip in the car becomes a 3 times as long when using public transport...
