    Default Resignation not given

    The company I work for have said that I put in a verbal resignation. After a telephone with the boss stating that I was thinking of putting in my resignation because of a situation at work and that I would ring them on Thursday, my boss has taken that as a verbal resignation. When I went into day they said that they had sent out a letter saying I did resign and they accepted it. They then turned around and said they would offer me a. New contract. I don't want to go back and work for them and I don't want them to get away with their actions. Is there anything I can do?

    Go to their HR department (assuming they are a medium to big company and do have a HR department). The only real course of action they can take that you will see is to get paid out any notice period from them terminating your employment (assuming your 'resignation' voided any notice period payment), unless you change your mind about wanting to work for the company again (possibly in another area or under a different manager)

    Otherwise the only action you really have is to go to the Fair Work Ombudsman at Making a workplace complaint - Complaints - Fair Work Ombudsman unless you are already a member of an employee body, which I doubt you would be if looking for advice online.

    It has been my experience that there is no such thing as a verbal resignation. The only time it would be applicable is if you Said "I quit" and then walked out and didn't come back. That is then abandonment of employment.

    Without knowing the full story I would agree with cottoneyes. You will need to seek assistance from the FWO or an Employee representative organisation.

    I don't see anything wrong with their intentions. They did what you requested on both occasions. Admittedly not the correct process, but I am guessing they are not HR specialists.

    I am also sure if you went to the employee representative (as mentioned in the previous replies), they would be happy to nullify your verbal resignation.
