Default Avoid Prosecution By The Fair Work Ombudsman

Clients always ask us, How do we avoid being prosecuted by the Ombudsman for paying under the wrong award? The answer is simple. The only way is by replacing the Modern Award with an Enterprise Agreement. An Enterprise agreement provides legal certainty of which Industrial Instrument applies to your staff.

Australian employees generally will be covered by a Modern Award unless they are covered by an Enterprise agreement. The only method to ensure that the Ombudsman cannot dispute and prosecute you for paying under the wrong award is to make that Enterprise agreement.
