A former CBA employee has successfully argued that by not trying to find him an alternative role in the company, the bank breached his conditions of employment.

Last week’s Federal Court judgment establishes for the first time in Australia that employers have certain obligations to employees and that a failure to fulfil those – such as by serious breaches of their own workplace policy – renders them liable to claims of damages. While this obligation has been recognised for almost two decades under English law, it has not been in Australia – until now.
