View Full Version : Time period to re-employee after redundancy?

Hi

Is there a set time period around promoting someone into a role after that role was made redundant? Obvioulsy the duties of the role will change slightly.

I can not seem to find any legislation around this.

Any ideas would be appreciated.

You are unlikely to find any legislation on it because if a position is genuinely redundant, it is not expected that someone would be employed in that position in the foreseeable future.

Of course business circumstance may change and the duties of the position may become needed again but if the time frame is relatively short there is always a risk that the person who was previously retrenched may find out and make a claim against you.

It may be wise to make the job title quite different.

How much time are we talking about?

Moz is right - make sure you have a very different job title (perhaps even a different grading/pay scale to that of the redundant job) and as a precaution, use a timeframe similar to that of reemployment and continuity of service - ie wait three months before you decide to create a new role.

Essentially the time is about 3months since the role was made redundant.

I have advised that the title of the role and responsiblities of the role must be changed.
