Hi ,

Can anyone help to simply the eligbilty, entitlement of the Long Service Leave Policy in Sydney, as the informion from the Fair Work Act 2009 is so complicated for a non-australian.

Can anyone help me on :

1. Who can Eligible
2. What is the entitlment.
3. Leaves can accumulate until they date he/she retired ?
4. if leave can keep until the date of he retired, then those balance will need to "enchash" , right ?
5. The long service leave is added on top of the annual leave per year, right ?

Can anyone help me on :

1. Who can Eligible - any employee hired within that state (including casuals), contractors are not eligible, unless they can prove and employee / employer relationship in which case they will become eligible after a court direction
2. What is the entitlment. 2 months leave after 10 years of service, 1 month or pro -rata for each five years after this. Leeave is paid out at the higher of the current regular weekly wage, the average weekly wage over the last 12 months, or the average weekly wage over the last 5 years. Some overtime, commissions and bonuses can be included in these calculations
3. Leaves can accumulate until they date he/she retired Leave is accumulated for all service other than periods of unpaid leave such as maternity?
4. if leave can keep until the date of he retired, then those balance will need to "enchash" , right ? Leave is cashed out on termination after 10 years, or 5 years if instigated by the employer or in very special circumstances
5. The long service leave is added on top of the annual leave per year, right ? correct, all long service leave entitlements are in addition to any annual leave entitlements, and annual leave will continue to accrue during any long service leave absences
