Hi all :)

We have an apprentice who is lazy and non compliant with managerial requests (provide proof of HR licence necessary for client).
We are a labour hire company and our clients are mining organisations like RIO, FMG etc....
Does anyone know of what our rights are in regards to suspension of the apprenticeship?
This apprentice has been spoken to by upper management (3 times) and the Director (3 times) across the last couple of years, and he still maintains his poor attitude......

Apprentices are treated no differently in instances like this than any other employee. Document the issue in detail and start down the path of performance management.

Suspension or Cancellation ? Suspension is usually only used when there is something temporarily preventing either the apprentice or the employer from fullfilling the requirements of the training contract (eg Injury or short term incapacity, down turn in work, short term closure, etc). Suspensions usually can be applied for through your State Training Authority, for periods of 3 months or more. Suspensions are usually done by agreement of the parties.

Sounds to me as if you want to terminate the apprentice - in that case you would cancel the training contract - reason, as Qld IR said - termination due to documented poor performance.
