View Full Version : Working Whilst On LSL ?

G'Day All - first time poster. Great site.

Quick question; I know it is not allowable in some states to work (for another employer) whilst on Long Service Leave. However for the life of me, and with some unwanted blocking from our companies wonderful IT configuration:mad:, I cannot find the answer as to the rule in NSW.

So can an employee covered by the NSW LSL Act work whilst on LSL?

Can't answer your question but I would point out not to go searching on work equipment while your at work or that IT department might be watching you :)

Looks as though the current guides and legislation in NSW is silent on whether you are able to undertake other paid work during your LSL. Only Vic, SA and WA are specific in stating you are not able to do so

To add to the question from Sea Eagle, can an employer give an employee 4 weeks notice to take LSL? The accrual date was several years ago.

The West Australian LSL Act states the employer and employee must be in agreeance.

Where an employer and employee have not agreed when the employee is to take the employee’s long service leave, the employer is not to refuse the employee taking, at any time suitable to the employee, any period of long service leave to which the employee became entitled more than 12 months before that time.

So in WA, No the employer cannot give 4 weeks notice for the employee to take LSL.... Correct me if I am wrong.
