Hi
I saw another question regarding LWOP but it didn't answer my question.
If an employer approves LWOP for a year, is the employer required to give the employee the same job on return?
If the same job is not longer available what are the legal rights of the employee?
Is the employee entitled to the same salary, regardless of the role they return to?
What are the regulations for this if it isn't stated in company policy?

you cannot reduce the terms of pay and conditions that have been agreed to, however if a restructure has taken place, their position may be redundant and they can be offered a move to another position if appropriate or made redundant...depending on the size of your business there are rules about whether you offer an alt position etc...
