Hi,

I was just wondering whether employees can take leave without pay while they still have annual leave?

If so where is this stated?

Fairly certain there is no legislation around this.

They can certainly request it with hope but as an employer you can refuse unpaid leave and suggest they take their annual leave?

Most companies usually write something into their leave policy stating that all other forms of leave must be exhausted before unpaid leave can be taken to stop this occuring.

Agree there is no legislation on this, therefore a policy signed off by employees when they start saves alot of issues down the track

There would have to be very unusual circumstances to allow an employee to take unpaid leave when they have paid leave accrued.

The only instance I know if it happening are in workplaces where ALL paid leave periods are fixed, such as a school.

What are the circumstances sylvia?
