Just in case anyone is not aware, from 1 Jan, 2010, it is a requirement that all employers provide new employees with a copy of the Fair Work Information Statement as soon as possible after their commencement.

The statement contains the 10 minimum workplace entitlements in the National Employment Standards, one of which is "the right for new employees to receive the Fair Work Information Statement".

Employers who breach the Standards face personal penalties of up to $6,600 and their businesses face penalties of up to $33,000 - per breach. It is essential that businesses fully comply with all ten Standards.

Lawyers are suggesting that employers establish a process for complying with the NES provisions which deal with the Fair Work Information Statement, including documenting how and when the Fair Work Information Statement was provided to each employee.

It's pretty easy for an employee involved in a dispute to claim they never received it!

A copy of the statement can be found here (http://www.fairwork.gov.au/Pay-leave-and-conditions/Conditions-of-employment/Documents/Fair-Work-Information-Statement.pdf)
